1. Who we are

Stream IQ Hub (the "Service") is operated by Kelly Plank, a sole proprietor based in the United States ("we", "us", "our"). By creating an account or using the Service you ("you", "user") agree to these Terms & Conditions.

2. Acceptance

Continued use of the Service constitutes acceptance of these terms. If you do not agree, do not use the Service. You confirm you are of legal age in your jurisdiction and, if using on behalf of an organization, that you have authority to bind it.

3. The Service

Stream IQ Hub provides tools for content creators, including AI-assisted generation (titles, hashtags, bios, mentoring), a resource library, an asset store, community features (LFG, pods, challenges, review exchange), and a marketplace for digital products.

4. Acceptable use

You must not misuse the Service. In particular, you agree not to:

  • use the Service unlawfully or for fraudulent, deceptive, or spam purposes;
  • infringe the intellectual property, privacy, or other rights of any person;
  • upload malware, probe or interfere with security, or scrape the Service;
  • generate content that is illegal, hateful, harassing, sexually exploitative of minors, defamatory, or a deepfake of a real person without consent;
  • attempt to jailbreak, reverse engineer, resell, or circumvent technical or plan limits of the Service or its AI features;
  • use outputs of AI features to provide regulated professional advice (medical, legal, financial) without your own review and qualification.

5. AI-generated content

Stream IQ Hub includes generative-AI features. You are responsible for the prompts you submit, for verifying the accuracy and suitability of outputs, and for ensuring you have the rights to any material you input. AI outputs may be inaccurate, biased, or offensive; treat them as drafts, not authoritative advice. We may remove, filter, or refuse outputs and suspend accounts that repeatedly violate these terms or infringe third-party rights. To report infringing content, contact us at the address in section 13.

6. Accounts and user content

You are responsible for keeping your credentials confidential and for all activity under your account. You retain ownership of content you submit. You grant us a limited, worldwide, non-exclusive license to host and process your content solely to operate and improve the Service. You must have the rights to any content, links, or digital products you list on the marketplace.

7. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under your selected plan.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refunds are governed by Paddle's Buyer Terms. Subscriptions renew automatically until canceled.

9. Marketplace

Digital products listed on Stream IQ Hub are provided by their respective creators. We are not a party to those transactions beyond providing the platform and payment infrastructure via Paddle. Sellers are responsible for their listings, license terms, and support.

10. Suspension and termination

We may suspend or terminate access for material breach, non-payment, suspected fraud or security risk, or repeated or serious violations of these terms. On termination, your right to use the Service ends immediately; you may export data where such export is offered in-product.

11. Warranties and liability

The Service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law, including merchantability and fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability that cannot be excluded under applicable law (including for fraud, death, or personal injury caused by negligence).

12. Indemnity, law, and disputes

You will indemnify us against third-party claims arising from your content, unlawful use of the Service, or breach of these terms. These terms are governed by the laws of the United States and the State of the operator's residence, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located there, unless applicable consumer-protection law requires otherwise. We may assign these terms in connection with a merger, acquisition, or sale of assets. Force majeure events excuse performance to the extent they prevent it.
